Dear Mr. Korsky:

Your follow up letter of April 22, 2002 regarding laws or regulations that require wearing shoes in places such as restaurants has been referred to me for response. You asked for confirmation that there are no statewide regulations on such matters and that these issues are solely under the jurisdiction of the counties.

This letter will serve to confirm that there are no statewide laws or regulations requiring the wearing of shoes in public places such as restaurants. The governance of this matter therefore is left up to the counties or cities to enact ordinances if they so desire. To my knowledge I know of no local jurisdictions that have enacted such requirements. Many establishments place warnings on their doors that if shoes or shirts are not worn within their facilities there will be no service. These requirements are placed on the consumer by the establishment unless there is a specific citation of a local ordinance.
