Dear Mr. Korsky:
Subject: Laws or Regulations Regarding Requirement for Wearing of Footwear in Restaurants, Stores, Schools, and other establishments. Thank you for your inquiry concerning the existence of Colorado laws or regulations that require the general public to wear shoes or other footwear inside public places.
Neither the Food Protection Act, Title 25, Article 4, Part 16, Colorado Revised Satutes (2000) nor the Colorado Retail Food Establishment Rules and Regulations address the issue of patrons being required to wear shoes inside retail food establishments. If some retail food establishment operators post signs at their entrance that read, "Shoes required, by order of the Health Department," this statement is made solely at the discretion of the individual operator. In Colorado, the Health Department does not have statutory or regulatory authority to enforce this requirement.
