RE: SHOE WEARING REQUIREMENT IN FOOD ESTABLISHMENTS

Dear Mr. Shakely:

This letter is in response to your correspondence of June 6, 1997, concerning Idaho health codes which require consumers to wear shoes in food establishments. A review of the health laws and rules of the State of Idaho revealed no requirements.

This agency is aware of reports of food establishments in Idaho restricting service to individuals without shirt and shoes and a common reason for the restrictions have been attributed to health requirements. This is obviously not the case. Owners of food establishments do have the right to set dress standards for their consumers.
