April 8, 2009 Dear Mr. Whitaker: I have received your letter dated March 31, 2009 in which you ask about regulations pertaining to patrons of food establishments to wear shoes. Idaho does not have specific regulations related to this. In April, 2005, Idaho adopted, by reference, the 2001 Food and Drug Administration (FDA) food code. Since that time, we have made some minor modifications and will consider adoption of future editions of the FDA food code as they become available. The FDA food code does not address the issue of patrons of food establishments wearing shoes. Please feel free to contact me if you have any other questions or concerns.
