Dear Mr. Rupprecht:
Your letter, inquiring of any state requirements that would require patrons of food establishments to wear shoes, was referred to me for a response. The Kansas Department of Health and Environment, Bureau of Environmental Health Services is responsible for the enforcement of state rules and regulations as they pertain to food establishments. There is no requirement in state regulations (Kansas Administrative Regulations 28-36-21 through 28-36-29 and 28-23-81 through 28-23-89) that patrons must dress in any manner. These regulations are specific for retail food restablishments, such as grocery stores, bakeries, and restaurants. Each establishment may set their own standards for dress. The statement that is occasionally seen in establishments, "No Shoes, No Shirt, No Service" is not a state requirement.
