Dear Mr. Shakely:
This letter serves as a response to your recent inquiry to our Department concerning regulations dealing with the wearing of shoes in foodservice establishments. In North Dakota there is no specific requirement that states customers must wear footwear in such establishments. In most situations it is the decision of the owner or manager of the facility that decides whether patrons wear shoes or shirts. Although not a regulation, it is generally recognized that the wearing of footwear is preferred to prevent possible injury to the customer and to prevent the spread of diseases.
