Dear Mr. Shakely:
Your letter of June 6, 1997 has been forwarded to me for comment. Our rules for food service establishments are called He-P 2300, NH Rules for the Sanitary Production and Distribution of Food.
The only section of the rules that deal with apparel of any kind is He-P 2312.03 (a), "All food service employees working in food preparation areas shall wear clean uniforms or clean bib-type aprons." or (b), "Employees shall use effective hair restraints such as hair nets to prevent the contamination of food or food-contact surfaces."
To my knowledge, there is no other reference, either in rules or law, that requires shoes by worn "by order of the health department".
