Dear Mr. Shakely:

The commercial business that we regulate are the food service establishments (restaurants, convenience stores, bakeries, etc.); mobile food service establishments; lodging establishments (hotels, motels, b&b's, specialty resorts); and campgrounds.

We have no current regulations that prohibit customers that are not wearing shoes or shirts from entering these establishments and obtaining service in the service areas. However, employees in these establishments must wear shirts and shoes as a matter of effective personal hygienic practices and to prevent contamination of food, equipment, utensils, linens, or other facilities. The administrative rules in South Dakota regarding this subject are too numerous to list. If you would like copies of our rules, we would be happy to send you several health & sanitation manuals that we distribute.
